Strong introduces SAFEGUARDS Act to ensure aviation security fee funds airport safety upgrades

U.S. Representative Dale Strong introduced the Spending Aviation Fees for Equipment, Guaranteeing Upgraded and Advanced Risk Detection and Safety (SAFEGUARDS) Act on May 12, together with Congressman Tim Kennedy of New York’s 26th district. The legislation aims to make sure that revenue from the 9/11 Passenger Security Fee is used specifically for aviation and airport security as originally intended.

The issue matters because since 2014, about $15 billion in revenue from the $5.60 fee paid by every airline passenger has been redirected to non-security purposes, even though it was meant to fund improvements in aviation security nationwide. The SAFEGUARDS Act seeks to restore these funds for their original use, particularly as the Transportation Security Administration faces increased passenger volumes ahead of major international events expected in coming years.

“As we prepare to host millions of visitors for major international events and continue facing evolving threats to our homeland, we must ensure TSA has the resources necessary to secure our airports with modern screening technology and upgrades that keep passengers safe. The SAFEGUARDS Act ensures that the resources are available to do just that,” said Representative Dale Strong (AL-05).

The bill would allocate $500 million annually from Passenger Security Fee revenue for checked bag explosive detection systems and designate $250 million each year for checkpoint technology improvements. It is co-led by Kennedy and co-sponsored by Homeland Security Committee Chairman Andrew R. Garbarino (NY-02), Subcommittee on Border Security and Enforcement Chairman Michael Guest (MS-03), Gabe Evans (CO-08), and Ryan Mackenzie (PA-07). “The SAFEGUARDS Act is a necessary piece of legislation to provide increased funding that we rely on to keep our skies and cities safe… This legislation guarantees that the TSA has the resources it needs,” said Kennedy.

Supporters include airlines, airport associations, travel groups, and local officials such as Butch Roberts of Huntsville International Airport who said: “The SAFEGUARDS Act would ensure that passenger fees are returned to their intended purpose—investing in advanced technologies that enhance the safety and efficiency of air travel across the U.S.” Similar support was voiced by Airlines for America: “By reinvesting these funds in next-generation screening technologies… this legislation will enhance security, reduce checkpoint congestion and improve overall travel experience.” Additional endorsements came from American Airlines, Southwest Airlines, U.S. Travel Association, Airports Council International–North America, and American Association of Airport Executives.

Strong currently serves in Congress representing Alabama’s 5th district after replacing Mo Brooks in 2023; he previously served at both state legislative levels according to his official House biography. Born in Monrovia in 1970, Strong resides in Huntsville according to his official House biography.

A similar version of this bill was introduced earlier by Senator Jerry Moran of Kansas.
